(3) A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.

(4) Our online store is intended exclusively for consumers. Commercial customers may contact us directly for individual offers.

(5) Contracts may be concluded in German or English.

§ 2 Conclusion of the Contract

(1) The presentation of our products in the online store does not constitute a legally binding offer but rather an invitation to place an order.

(2) You may initially place the desired products in the shopping cart without obligation. Before submitting your order, you may review and correct your information.

(3) By clicking the final order button, you submit a binding offer to conclude a purchase contract for the goods contained in the shopping cart.

(4) We accept your offer by means of an express order confirmation sent by email. This confirmation may be sent automatically immediately after completion of the ordering process. The purchase contract is concluded upon receipt of the order confirmation.

§ 3 Ordering Process and Contract Text

(1) Before submitting your order, you may review and change your selected products, order quantities, contact details, delivery and billing addresses, and payment method.

(2) We store your order information and send you the order confirmation, including the applicable General Terms and Conditions and the instructions on the right of withdrawal, by email.

(3) You may use a customer account for your order and view your orders there. It is also possible to place an order as a guest without a customer account.

§ 4 Prices and Shipping Costs

(1) All prices stated in the online store are in euros and include the applicable statutory Mehrwertsteuer (value-added tax, VAT).

(2) In addition, we charge a flat shipping fee of 5,95 € per order for deliveries within Germany. Shipping costs are shown separately before completion of the order.

(3) We do not offer free shipping.

§ 5 Payment Terms

(1) The payment methods displayed during the checkout process are available to you. These include the payment methods offered through Shopify Payments, PayPal, and advance payment by bank transfer.

(2) For Shopify Payments and PayPal, payment is initiated immediately upon completion of the order in accordance with the selected payment method.

(3) In the case of advance payment by bank transfer, the invoice amount must be transferred to the account specified in the order confirmation within seven calendar days after receipt of the order confirmation.

(4) In the case of advance payment, we ship the goods only after payment has been received in full.

(5) In the event of payment not being made within the specified period, the statutory provisions apply. In particular, we reserve the right to withdraw from the contract once the statutory requirements have been met.

§ 6 Delivery

(1) We deliver exclusively within Germany. Shipping is carried out by DHL or, provided that a suitable age verification service is available for the respective shipment, by DPD. Customer pickup is not possible.

(2) The delivery time for products in stock is 1–3 working days, unless a different delivery time is specified on the respective product page. In the case of advance payment, the delivery period begins upon receipt of payment.

(3) Partial deliveries are permitted insofar as they are reasonable for you. We bear any additional shipping costs incurred.

(4) Delivery to DHL Packstations or other automated parcel stations is excluded. Delivery to a DHL post office branch is possible, provided that the required age verification can be carried out there.

(5) Delivery to designated drop-off locations or neighbors is excluded.

(6) If a shipment cannot be delivered for reasons for which you are responsible, we may, in accordance with the statutory provisions, claim the demonstrable additional shipping costs caused thereby. Your statutory rights, in particular the right of withdrawal, remain unaffected.

(7) In the case of consumers, the risk of accidental loss and accidental deterioration of the goods generally passes only upon handover to you or to a person authorized to receive the goods.

§ 7 Product Availability and Delivery Delays

(1) The availability of our products is indicated in the online store.

(2) If a delivery delay occurs after conclusion of the contract, we will inform you without undue delay and, where possible, provide you with a new delivery date.

(3) If an ordered product is permanently unavailable, we will inform you accordingly. We may offer you a mutually agreed termination of the contract. In the event of reversal of the transaction, we will refund payments already made.

(4) Your statutory rights in the event of delayed delivery or unavailability remain unaffected.

§ 8 Protection of Minors

(1) We sell alcoholic beverages exclusively to persons who are at least 18 years old.

(2) During the ordering process, you must confirm that you are at least 18 years old.

(3) Upon delivery, an age verification is carried out by the commissioned shipping service provider. For DHL, we use the visual age verification service for persons aged 18 and over. The goods will only be handed over to a person who has reached the required minimum age.

(4) Handover to another adult person in the recipient's household is permitted, provided that the booked shipping service allows this. Delivery to neighbors or designated drop-off locations is excluded.

(5) If the required legal age of adulthood cannot be established upon delivery, the goods will not be handed over. Following any return shipment, we will clarify with you whether another delivery attempt is possible or whether the contract will be reversed in accordance with the statutory provisions.

§ 9 Right of Withdrawal

(1) Consumers have a statutory right of withdrawal.

(2) Detailed information on the requirements, time limits, exercise, and consequences of withdrawal, as well as the model withdrawal form, can be found here.

(3) You may declare your withdrawal, in particular, through the electronic withdrawal function provided on our website using the “Withdraw from Contract” button, by email to info@garyandgrisha.de, or by mail to Unbelievable Spirits – Rosing, Schrade und Weiß GbR, Herbert-Haydin-Straße 22, 64646 Heppenheim, Germany. Use of the model withdrawal form is not mandatory.

(4) We do not grant any additional voluntary right of return. Decisions to make exceptions as a gesture of goodwill remain possible on a case-by-case basis.

§ 10 Discount Promotions

(1) If we offer discount codes or special promotions, the respective stated promotional terms and conditions apply.

(2) Multiple discount promotions may only be combined if this is expressly provided for.

(3) Discounts granted free of charge will not be paid out in cash. Statutory claims for reimbursement remain unaffected.

§ 11 Retention of Title

The delivered goods remain our property until payment has been made in full.

§ 12 Statutory Rights in the Event of Defects and Transport Damage

(1) The statutory rights relating to liability for defects apply.

(2) We ask that you report any obvious transport damage, if possible, at the time of delivery and notify us promptly. Photographs of the damaged goods and packaging are helpful.

(3) Reporting such damage is voluntary. Failure to report damage, or a delay in reporting it, has no effect whatsoever on your statutory rights in the event of defects.

(4) For complaints, you may contact us by email, telephone, or mail using the contact details provided in § 1.

(5) Additional voluntary guarantees apply only if they are expressly stated for a product.

§ 13 Liability

(1) We are liable without limitation for damage resulting from intent or gross negligence, as well as for damage resulting from injury to life, body, or health.

(2) In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfillment makes the proper performance of the contract possible in the first place and on whose fulfillment you may regularly rely.

(3) In all other respects, liability for damage caused by slight negligence is excluded to the extent permitted by law.

(4) Liability under the German Product Liability Act (Produkthaftungsgesetz), in the event of the assumption of a guarantee, and in cases of fraudulent concealment of a defect remains unaffected.

§ 14 Consumer Dispute Resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer dispute resolution body.

§ 15 Applicable Law

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory statutory consumer protection provisions remain unaffected.

§ 16 Final Provisions

Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
